Poole and Case were never taken to the prison but remained in Portland until the decision of the lower court was overturned in June 1896. The following month the prisoners were released on their own recognizance. Case began working his way up the coast toward Tacoma, Washington, probably committing petty crimes along the way, and he was conspicuous in several cities because of his rowdy behavior. On January 28, 1897, a train was robbed at Shady Point, Oregon, two miles west of Roseburg. Case was suspected, but there was no evidence to implicate him, so he was not arrested. Case finally reached Tacoma in May 1897 and began planning a robbery. On May 23 he tried to rob the Stellacoom streetcar but Superintendent Frank Dame was aboard. Dame drew his pistol and exchanged shots with Case. Although shot in the left arm, Dame managed to mortally wound Case. At the robber’s inquest Case was positively identified by three men who knew him; his picture had arrived from Roseburg and perfected the identification. In September 1897, with Case dead, the indictments against Poole and Case were dismissed, so no one ever served time in prison for the Cow Creek Canyon train robbery.
